1. Acceptance of Terms

 

By accessing or using the LDFK website and/or registering for any LDFK event or community forum (the "Service"), you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you disagree with any part of the terms, then you may not access the Service.

 

2. Eligibility and Membership

 

  • Age: You must be at least 18 years old to use this Service and register for LDFK organized drives.

  • Registration: When you create an account or register for an event, the information you provide must be accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms.

 

3. Trip and Event Participation Rules

 

Participation in any LDFK organized drive or event is subject to the following mandatory conditions:

  • Vehicle Condition and Documents: All participating vehicles must be roadworthy, legally registered, insured, and possess all necessary valid documentation (e.g., permits, licenses, PUC certificate).

  • Driver Conduct: Participants must strictly adhere to all local, state, and national traffic laws and regulations. Consumption of alcohol or non-prescription drugs while driving during LDFK events is strictly prohibited.

  • Risk Acknowledgement: Long drives, especially to remote or high-altitude locations, involve inherent risks including, but not limited to, accidents, vehicle breakdown, extreme weather, and medical emergencies. Participants acknowledge and voluntarily assume all such risks.

  • Compliance with Coordinators: Participants must follow the instructions and safety guidelines issued by LDFK trip coordinators (marshals) at all times during the drive. LDFK reserves the right to remove any participant from an ongoing drive due to persistent violation of safety rules or disruptive conduct.

  • Liability Waiver: LDFK, its organizers, members, and volunteers are not liable for any injury, loss of life, damage to property, or theft that may occur during participation in any organized drive or event.

 

4. User-Generated Content (UGC)

 

  • Responsibility for Content: You are solely responsible for all content, including text, photographs, and videos, that you post, upload, or link to the Service.

  • Content License: By posting content on the LDFK website or official social media channels, you grant LDFK a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, publish, and distribute your content for the purpose of promoting LDFK, documenting events, and operating the Service.

  • Prohibited Content: You agree not to post any content that is illegal, defamatory, obscene, threatening, or infringes upon the rights of any third party.

 

5. Intellectual Property

 

  • Ownership: The Service and its original content, features, and functionality (excluding UGC) are and will remain the exclusive property of LDFK. This includes the LDFK logo, branding, and website design.

  • Use Restriction: You may not modify, copy, reproduce, or use any part of the Service's intellectual property without the express written permission of LDFK.

 

6. Links to Other Websites

 

Our Service may contain links to third-party websites or services that are not owned or controlled by LDFK. LDFK has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that LDFK shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

 

7. Termination

 

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

 

8. Disclaimer of Warranties

 

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. LDFK makes no warranties of any kind, express or implied, regarding the operation of the Service or the information, content, or materials included therein. LDFK does not warrant that the website will be uninterrupted, timely, secure, or error-free.

 

9. Governing Law

 

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Kolkata, West Bengal, India.

 

10. Changes to Terms

 

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
